    Art. 1 Scope of Application, Customer Information

    The following General Terms and Conditions of Business (the “Terms and Conditions”) shall govern the contractual relationship between the company NC Solution based in Warsaw/Poland and consumers who purchase goods through the NC Solution internet shop. Terms and conditions of an entrepreneur that conflict with or deviate from these Terms and Conditions will not be recognized. These Terms and Conditions also include customer information pursuant to the Polish personal data protection law.
    NC Solution is the owner of the Senmata brand and trade mark as well as the owner of the internet store

    Art. 2 Conclusion of Contract

    (1) The offers on the Internet constitute a non-binding invitation to you to purchase goods.
    (2) By entering your data and clicking on the “Order” button, you make a binding offer to conclude a purchase contract.
    (3) We have the right to accept your offer within 5 days by sending an order confirmation by email. If no such confirmation is sent within the period stated in sentence 1, your offer is to be deemed rejected, so that you will no longer be bound by your offer.

    Art. 3 Terms of Payment

    We generally accept payment in advance, payment by PayPal and payment by credit card.
    (1) Payment in advance
    For payment by money transfer, NC Solution  will inform you of the bank account details in the email confirming the order and will dispatch the goods on receipt of payment. Payment must have been received on NC Solution bank account within 2 weeks from receipt of the order confirmation.  NC Solution requires all international transfers to us to be made with the OUR instruction, which means that all bank transfer charges are to be born by the sender, and the order amount must be received on our end in full.
    2) PayPal
    In the case of payment by PayPal, the PayPal account data will be sent to you in the course of the ordering process or in the email confirming the order. Payment will be made immediately from your PayPal account to our PayPal account.
    (3) Payment by credit card
    The goods will be dispatched as soon as the amount has been credited to our account. Payment must be made to the NC Solution account within 2 weeks from receipt of the order confirmation.

    Art. 4 Delivery

    (1) If  NC Solution accepts your order, the goods will be delivered as soon as possible, but within 5 working days. In the case of orders with payment in advance, the goods will only be dispatched on receipt of the full amount by NC Solution. We will reserve the ordered goods for 7 days prior to the receipt of payment, after that period we can cancel your order.
    (2) If we are unable to deliver ordered goods through no fault of our own, e.g. because one of our suppliers is in breach of its contractual obligations, we shall have the right to cancel the contract with you. In this case, we will inform you immediately that the ordered goods cannot be supplied. Any payments already made by you will be returned immediately.
    (3) Delivery will be made to the address stated by you in the order.
    (4) Before accepting the delivery from the parcel delivery service, please ensure that the package or packages has/have not been opened, damaged or tampered with in any way. Should they have been, you should make a written record to this effect in the handover record presented by the parcel delivery service driver.

    Art. 5 Articles, Prices, Delivery Costs

    (1) The product offered by us is original, trademarked and patented. Depending on the computer screen used by you, colours and colour shades of the articles shown on the screen may differ from those of the original item.
    (2) Trade marks and brand names are the property of NC Solution.
    (3) All prices include value added tax at the statutory rate but are subject to the addition of delivery costs. The article and delivery costs valid at the time of ordering apply. You will be informed of the delivery costs during the ordering process and here (Terms and Conditions of Delivery).

    Art. 6  Return Policy and Return Costs

    (1)A full merchandise refund (full price of the product), excluding shipping charges will be issued if you wish to return the product during the return period, which is within 10 days from receiving the product.
    (2)All merchandise must be shipped back in its original packaging and the packaging must not be defaced in any way. All parts and instructions must be returned. All returns must be accompanied by a copy of your invoice and a return form filled by you.
    (3)The product cannot bear any marks of being used or washed and needs to be returned to the delivery address provided by us, after you receive a return merchandise authorization from us and the return form to fill.
    (4)If you return a product without first contacting us and obtaining authorization to return, you will not receive a refund, and the product might even be lost in transit.
    (5)We reserve the right to refuse a refund based on the condition of the received merchandise.
    (6)No shipping cost will be refunded by us – responsibility to order cautiously and responsively relies on the customer.

    Art. 7 Reclamation

    In the case of purchase of new goods, submitting a reclamation as set forth in the statutory regulations shall apply. Minor differences in colour between illustrations and the delivered goods are due to technical reasons. Defects which are due to failure to comply with care instructions (see label) or to normal wear and tear shall likewise not constitute a fault or non-compliance.
    Reclamations need to be reported to us via customer portal built into the internet store or by filling out a reclamation form provided by us via mail. If the  claim is legitimate we will advise possible options (money return, qualified replacement or repair of product elements).

    Art. 9. Duty Taxes

    All duty taxes (for countries outside of the EU) are the responsibility of the receiver.
    Because we have no control over what a country will charge, it is the receiver's responsibility to pay all Taxes, Custom Charges and Duty Fees. Please note that in some countries these charges can be anywhere between 10 – 50 % of the price of the goods that you've purchased. IF YOU REFUSE THE ITEMS AT THE TIME OF DELIVERY BECAUSE YOU DON'T WANT TO PAY THE TAX YOU WILL STILL BE CHARGED FOR OUR SHIPPING CHARGES, THE CUSTOM CHARGES AND THE RETURN SHIPPING CHARGES.

    Art. 8 Applicable Law

    All disputes arising from or on the basis of these Terms and Conditions shall be governed by Polish law; the UN Convention on Contracts for the International Sale of Goods shall not apply.
